TERMS AND CONDITIONS ANNEX A
Preamble eKomi Terms & Conditions Annex 1:
By confirming the online purchase of an eKomi service as a registered user in an eKomi web application, I confirm that I have read and agree to the addendum “eKomi Terms & Conditions Annex A 1.a. - 1.e.”
eKomi Terms & Conditions Annex 1.a.
eKomi will submit to the company a written offer as a completed order form. The completed order form (hereinafter, collectively referred to as the 'contract offer') will include a detailed description of services and will require an authorized signature by the company. The final signed contract is thereby ratified and completes the contract process. As an alternative to the contract offer, eKomi services can be purchased by a registered user in an eKomi web application.
eKomi Terms & Conditions Annex 1.b.
The eKomi contract goes into effect either upon eKomi’s receipt of the legally-binding order form signed by the Company or by confirming the online purchase of an eKomi service as a registered user in an eKomi web application. The transmission of the initial signed order form is generating an eKomi account as a registered user. The transmission of the signed order form can take place by mail, by fax, by email (scanned copy) or in case of signing with electronic signature by electronic means. The contract is concluded with acceptance of the application of the Company and the confirmation of its registered user account by eKomi.
The contract will hereby be nullified and voided, if the Company has modified or edited the content of the order form that has been issued by eKomi."
eKomi Terms & Conditions Annex 1.c.
Payment of the subscription fees is due on the date of the acceptance of the web application of the Company and the confirmation of its registered user account by eKomi; on the renewal date of the subscription; and, on the date of an additional purchase by the Company in an eKomi web application.
eKomi Terms & Conditions Annex 1.d.
The company shall pay the subscription fees by credit card or electronic debit through eKomi’s third-party payment processor as listed in eKomi Terms & Conditions Annex 1.e. The Company assures that sufficient funds are available via their chosen payment vehicle.
